Public Beta Terms

These Public Beta Terms ("Beta Terms") govern your access to and use of UXbeam's public beta service.

UXbeam is operated by Sandra White. Contact: support@uxbeam.com.

By creating an account or using the signed-in service, you agree to these Beta Terms. If you do not agree, do not create an account or use the service.

1. Public Beta Status. UXbeam is an experimental public beta providing user-research tools, including tree testing, card sorting, competitive app analysis, and other features that may be added, changed, tested, or removed over time.

The beta may contain defects, incomplete features, inaccurate outputs, interruptions, or significant changes. It is not intended to provide guaranteed, uninterrupted, production-critical infrastructure.

You should retain independent copies of important research materials and results.

2. Eligibility. You must be at least 18 years old and legally capable of agreeing to these Beta Terms to create or operate a UXbeam account.

You may use UXbeam on behalf of an organization only if you have authority to accept these Beta Terms for that organization.

3. Free Beta Access and Future Pricing. UXbeam's current public beta is provided without charge.

Free access does not guarantee that every feature will remain available or free. UXbeam may introduce paid plans, credits, usage limits, or other pricing in the future.

You will not be charged merely because pricing is introduced. Any paid purchase will require separate, explicit action and disclosure of the applicable price and terms before payment.

4. Accounts and Security. You must provide accurate account information and take reasonable steps to protect your login credentials.

You are responsible for activity conducted through your account unless it results from circumstances outside your reasonable control.

You must notify UXbeam at support@uxbeam.com if you believe your account has been accessed without authorization.

You may not share access in a way that bypasses product restrictions, enables abuse, or permits another person to impersonate you.

5. Permitted Use. UXbeam grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the beta for lawful research, learning, evaluation, and internal business purposes.

You may create studies and share participant links for legitimate user-research activities.

6. Researchers and Study Participants. You are responsible for the studies you create, the questions and content you provide, the people you invite, and the lawful basis for collecting and using participant information.

UXbeam does not require participant names or email addresses by default. However, a participant may be invited to enter an optional identifier, which may be an ID, name, or email.

You must not use UXbeam to conduct a study involving a person under 18 unless you have obtained legally valid consent from that person's parent or legal guardian and complied with all laws, institutional requirements, and research standards applicable to the study.

You must not use UXbeam to deceive, exploit, harass, discriminate against, improperly monitor, or collect unnecessary sensitive information from participants.

UXbeam does not verify participant ages or independently validate the consent obtained by researchers.

7. Prohibited Use. You may not:

  • use UXbeam for unlawful, fraudulent, abusive, deceptive, or harmful activity;
  • attempt to gain unauthorized access to UXbeam, another account, or connected systems;
  • interfere with the security, availability, or normal operation of the service;
  • introduce malicious code or deliberately overload the service;
  • scrape, crawl, or systematically extract UXbeam content or data without written permission;
  • reverse engineer, decompile, or attempt to obtain UXbeam source code except where applicable law expressly permits it;
  • copy UXbeam's proprietary interface, workflows, branding, or non-public technology to create a competing product;
  • rent, resell, sublicense, or commercially redistribute access to the beta;
  • use study links to collect personal information without appropriate notice and consent;
  • upload content that infringes intellectual-property, privacy, confidentiality, or other legal rights; or
  • impersonate another person or misrepresent your relationship with a person or organization.

UXbeam may investigate suspected abuse using information reasonably necessary to understand and protect the service, such as account records, security logs, error information, and relevant service activity.

This does not authorize unrestricted surveillance or use of account activity for advertising, profiling, or unrelated purposes. UXbeam's collection and use of information remain governed by the Privacy Policy.

8. Your Content. You retain ownership of the study content and materials you create or upload to UXbeam.

You grant UXbeam a limited, non-exclusive license to host, process, reproduce, and display that content only as reasonably necessary to operate, secure, support, and improve the service.

You represent that you have the rights and permissions needed to provide the content and use it in your studies.

UXbeam does not acquire ownership of your research content merely because it is stored or processed through the service.

9. UXbeam Intellectual Property. UXbeam's software, interface, design, brand, documentation, workflows, and underlying technology remain the property of UXbeam and its applicable licensors.

These Beta Terms do not transfer ownership of UXbeam or its intellectual property to you.

If someone improperly copies, extracts, misuses, or attempts to obtain UXbeam's technology or protected materials, UXbeam may suspend access and pursue any remedies available under applicable law, including injunctive relief and recovery of provable losses.

10. Feedback. You may voluntarily provide suggestions, bug reports, ideas, or other feedback.

You are not required to provide feedback or participate in interviews or meetings.

UXbeam may use feedback without restriction or compensation, provided that doing so does not transfer ownership of your underlying research content or confidential materials.

11. Privacy and Service Providers. UXbeam's collection, use, sharing, retention, and protection of information are described in the Privacy Policy.

UXbeam uses service providers to operate parts of the service, which may include hosting, authentication, email delivery, artificial-intelligence APIs, and consent-based product diagnostics.

Use of those providers remains subject to the commitments described in the Privacy Policy.

12. Support and Account Access. UXbeam may access limited account or project information when reasonably necessary to:

  • respond to a support request;
  • investigate a security incident or suspected abuse;
  • diagnose a technical failure;
  • comply with a valid legal obligation; or
  • maintain the operation and integrity of the service.

UXbeam will not enter accounts merely to monitor individual users for advertising or unrelated surveillance.

13. Account Deletion. You may delete your account through the Account page.

Account deletion removes or replaces your identifying account information, disables future sign-in, revokes active sessions, and closes participant links associated with your studies.

Research content and anonymous study responses may remain stored in de-identified form. Residual copies may also remain temporarily in routine backups.

You may contact support@uxbeam.com to request full erasure of remaining research content, subject to legal, security, backup, and technical limitations described in the Privacy Policy.

14. Suspension and Termination. You may stop using UXbeam or delete your account at any time.

UXbeam may immediately restrict or suspend access when reasonably necessary to address:

  • suspected abuse or unlawful activity;
  • a security threat;
  • interference with the service;
  • material violation of these Beta Terms; or
  • risks to UXbeam, users, participants, or third parties.

Where practical, UXbeam will explain the reason and provide an opportunity to correct the issue.

UXbeam may also change, pause, or end the public beta generally. Where reasonably practical, UXbeam will provide advance notice before a planned discontinuation. Emergency, security, legal, or operational circumstances may make advance notice impossible.

15. No Warranties. UXBEAM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY LAW, UXBEAM MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, DATA PRESERVATION, OR FITNESS FOR PRODUCTION OR BUSINESS-CRITICAL USE.

UXBEAM DOES NOT GUARANTEE THAT:

  • THE SERVICE WILL ALWAYS BE AVAILABLE;
  • FEATURES WILL WORK WITHOUT ERRORS;
  • DATA OR RESULTS WILL NEVER BE LOST;
  • OUTPUTS OR ANALYSES WILL BE COMPLETE OR ACCURATE;
  • A PARTICULAR FEATURE WILL REMAIN AVAILABLE; OR
  • USE OF UXBEAM WILL PRODUCE A PARTICULAR RESEARCH OR BUSINESS OUTCOME.

YOU USE AND RELY ON THE FREE BETA AT YOUR OWN RISK.

16. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, UXBEAM AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM OR RELATED TO:

  • USE OF OR INABILITY TO USE THE BETA;
  • SERVICE INTERRUPTIONS OR DISCONTINUATION;
  • LOST, CORRUPTED, OR UNAVAILABLE DATA;
  • INACCURATE OR INCOMPLETE RESULTS;
  • RELIANCE ON RESEARCH OUTPUTS;
  • LOST PROFITS, REVENUE, BUSINESS, OPPORTUNITIES, OR GOODWILL;
  • BUSINESS INTERRUPTION;
  • REPUTATIONAL DAMAGE; OR
  • INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

UXBEAM IS A FREE EXPERIMENTAL SERVICE, AND YOU ACCEPT THAT IT IS NOT OFFERED AS GUARANTEED OR BUSINESS-CRITICAL INFRASTRUCTURE.

NOTHING IN THESE BETA TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

17. Your Responsibility for Misuse. You are responsible for claims, losses, or reasonable costs resulting from:

  • your unlawful use of UXbeam;
  • studies you conduct without required consent;
  • content you provide without sufficient rights;
  • your violation of another person's privacy or intellectual-property rights; or
  • deliberate abuse of UXbeam's systems, service, or intellectual property.

This section does not require you to compensate UXbeam for conduct caused by UXbeam itself, and it does not create an automatic penalty or fixed fee.

18. Governing Law and Venue. These Beta Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to any legal rights that cannot be waived, disputes arising from these Beta Terms or use of UXbeam must be brought exclusively in the state courts located in Orange County, Florida, or the applicable federal court serving Orange County, Florida.

Each party consents to the jurisdiction and venue of those courts.

19. Changes to These Beta Terms. UXbeam may update these Beta Terms as the beta evolves.

Material changes will be communicated by email, an in-product notice, or a notice presented when you next sign in.

The updated terms will state their effective date. Where renewed agreement is legally or practically appropriate, UXbeam may require you to accept the updated terms before continuing to use the signed-in service.

20. Miscellaneous. If part of these Beta Terms is found unenforceable, the remaining provisions will continue to apply.

A failure to enforce a provision once does not waive the right to enforce it later.

You may not transfer your account or rights under these Beta Terms without UXbeam's permission.

These Beta Terms and the Privacy Policy form the current agreement governing access to the UXbeam public beta. They do not incorporate the unfinished general Terms of Service.
